on development plan Steve Rubenstein The city of Oakley failed to adequately consider the effects of a proposed 4,300-unit development on air quality and agriculture in a below-sea-level delta tract, a judge has ruled. Judge Diana Becton Smith upheld arguments by Greenbelt Alliance, which has called the proposed development "a disaster waiting to happen." But the judge upheld the city's position that it had adequately addressed concerns over levees and the protection of a rare species of hawk. "Greenbelt Alliance filed this lawsuit to get the city to address the impacts of this development," said Christina Wong, field representative for the environmental group. "Now the city should take this opportunity to rethink this dangerous plan." Oakley Director of Community Development Rebecca Willis said she was "thrilled that the judge backed us" on the issue of levees and potential flooding and pointed out that Oakley already has hundreds of below-sea-level homes. The city has 60 days to appeal the ruling. ### |
